| dc.description.abstract | صيغ مبدأ الاحتياط للمرة الأولى في عام 1992 في المبدأ 15 من إعلان ريو:" عندما تكون هناك تهديدات بوقوع أضرار جسيمة أو لا رجعة فيها، والافتقار إلى اليقين العلمي الكامل لا يمكن أن يكون مبررا لتأجيل اعتماد تدابير فعالة لمنع التدهور البيئي ". هذا المبدأ موجود بدرجات متفاوتة في المواثيق والاتفاقيات كما هو الحال في بعض القوانين الوطنية، في مجال الصحة البيئية. مثلما في الجزائر بالنص عليه في القانون 03-10 المتعلق بحماية البيئة في إطار التنمية المستدامة . إن وسائل تطبيق مبدأ الاحتياط تحتاج إلى وجود تجربة أو تجارب تبين مدى إمكانية الاستفادة منه، وهو ما يستدعي البحث في المسؤولية الملقاة على عاتق الدولة والفرد معا. | en_US |
| dc.description.sponsorship | The precautionary principle was first articulated in 1992 in Principle 15 of the Rio Declaration: “Where there are threats of significant or irreversible damage, the lack of full scientific certainty cannot be a justification for postponing the adoption of effective measures to prevent environmental degradation.” This principle is present to varying degrees in charters and agreements, as in some national laws, in the field of environmental health. As in Algeria, it is stipulated in Law 03-10 related to the protection of the environment within the framework of sustainable development. The means of applying the principle of precaution requires the existence of experience or experiments that show the extent to which it can be benefited from, which calls for research into the responsibility entrusted to the state and the individual together. | en_US |
