الاستعمال والإتجار غير المشروعين للمخدرات والمؤثرات العقلية على ضوء القانون 23/05

Abstract

إن انتشار جرائم المخدرات والمؤثرات العقلية وتفاقمها ,أصبحت نقوسا يدق خطرا علي استقرار كيان المجتمع الجزائري مما بات الأمر مقلقا نضرا لارتفاع نسبة معدلاتها ,لذا فإن مواجهتها تعتبر ضرورة وطنية ,وهذا ما دفع بالمشرع الجزائري لإصدار القانون 23/05 لوضع حد لهذه الظاهرة ,الذي ينص علي تدابير وقائية وأخري عقابية صارمة لتجريم كافة أفعال الاستعمال والإتجار غير المشروعين بها بهدف تقرير حق العقاب علي مرتكبيها ,وبتفعيل استراتيجية جنائية حديثة تشمل أليات الوقاية والعلاج والتوعية ,بهدف القضاء علي هذه الظاهرة وتأهيل وعلاج المدمنين .. The spread and escalation of drug and psychotropic substance crimes have become a threat to the stability of Algerian society, given the alarming worrying increase in their rates, consequently , tackling this issue is a national necessity, this prompted the Algerian legislator to issue Law 23/05 to curb this phenomenon, the law includes preventive and strict punitive measures to criminalize all acts of unauthorized use and trafficking, aiming to ensure the right punishment for the perpetrators, It also involves implementing a Morden criminal strategie that focuses on prevention ,treatment, and awareness, with the Gol of eliminating this phenomenon and rehabilitating addicts.
