الضمانات الممنوحة للمستثمرين الأجانب في التشريع الجزائري

Abstract

وقد نص المشرع الجزائري في قانون الاستثمار على عدد من الضمانات الرامية إلى اجتذاب المستثمرين الأجانب. وفر لهم بضمانات قانونية حرية الاستثمار الأجنبي الأسهم بين المستثمرين واستقرار التشريع. وعلاوة على ذلك، وضع بعض الضمانات لمنع حقوقهم المالية من الحصول على تعويض عادل في حالة نزع ممتلكاتهم من أجل المصلحة العامة وكذلك الحق في تصدير رؤوس أموالهم ومزاياهم إلى الخارج. حاول المشرع بموجب القانون 22/18 إزالة الحواجز الإدارية من خلال إنشاء منصة رقمية لجعل المستثمر قريبًا من الإدارة المتعلقة باستثماره مع التركيز على الإطار المؤسسي من خلال إنشاء الوكالة الوطنية لتنمية الاستثمار والمجلس الوطني للاستثمار وإضافة قاعدة قضائية تتكون من اللجنة الوطنية العليا للاستئناف. عن الضمانات القضائية التي قدمها للمستثمر في الاتفاقات التجارية التي تم اختيارها فيما يتعلق بالتسوية التجارية. حل نزاعات الاستثمار لبناء مناخ من الثقة بين المستثمر والدولة. المفتاح The Algerian Lawmaker has established in the investment code a number of guarantees aiming to attract foreign investorsBy theamendment of laws governing in the investment he has tried to correct the deficiencies registered in the guarantees granted to them . The Legislator has tried by the law 22/18 to eliminate the administrative barriers by establishing a digital platform to make the investor close to the administration related to his Investment emphasizing on the institutional framework by creating the National Agency for Investment Development and the National Investment council and adding a judicial base consisting in High National Commission of Appeals .About the judicial guarantees he offered to the investor tow ways either before the national justice or by amicable settlement chosen by the investor who often goes to the commercial international arbitration to settle the conflicts linked to his investment agreements regarding its experience and impartiality in such issues.
