Abstract

ظير عقدا الامتياز والتأجير كوسيمة ليب ا رلية بعد الني الجديد الذي سارت عميو الدولة الج ا زئرية خلال مرحمة 1989 وكان نتيجة حتمية لظيور ما يعرف بالم ا رفق العامة الكبرى الصناعية والتجارية وت ا زيد الحاجات العامة لمجميور، ما حتم عمى الدولة إش ا رك القطاع الخاص في تسيير جزء من الاموال العامة المييأة لتحقيق المنافع العامة لفترة زمنية محددة دون أن تتنازل عن ممكيتيا ليا رغم أن ىذين الأسموبين كانا قائمين بعد الاستقلال مباشرة ،إلا أن اعتمادىما مؤخ ا ر تم عمى وجو مغاير لما كانا عميو بعد أن كانا أسموبان استثنائيان لمتسيير أضحيا وسيمة فعالة وبارزة في تسيير الم ا رفق العامة، ورغم أن الج ا زئر كرست عقدي الامتياز والتأجير من خلال عدة نصوص قانونية، إلا أنيا بذلك لم تول ليما أىمية كبيرة، حيث لم تضبط مفيوما دقيقا لمعقدين ولم تميز بينيما إلا من خلال تعميمة و ا زرية خاصة )فتقريبا كل الامتيا ا زت التي نص عمييا المشرع الج ا زئري ىي إيجا ا رت، ىذا بالنظر لممعايير التي وضعيا الفقو والقضاء الفرنسي أي معيار إنشاء المرفق أي القيام بالبناء والتجييز (. وفي ظل المعطيات الج ا زئرية الحالية المتمثمة في البحث عن السبل البديمة لمتسيير الموجو و الإداري للاقتصاد الوطني، يمكن أن تشكل عقود الامتياز وعقود التأجير إحدى الوسائل لمخصخصة الجزئية للاقتصاد الوطني ومن بين السبل للانتقال من مرحمة سيادة القطاع العام إلى مرحمة إش ا رك القطاع الخاص في تحقيق النموL'importance de concessionnariat apparue depuis les réformes économiques que l'Algérie a entrepris en 1989,il se présente comme une nécessité absolue depuis l'ouverture du marché national qui a pour conséquences l'évolution et l'amélioration des services pour les besoins de la population dont les exigences ne peuvent être satisfaites par la gestion étatique qui ne peut être dans les normes requise, bien que l'Algérie a consacré le contrat de la concession et L'Affermage à travers plusieurs textes juridiques ,mais il ne leur pas donnés une grandes importance ?là où il n'a pas donné un concept précis au contrat de la concession et L'Affermage , seulement ce qui a stipulé dans une instruction ministérielle spéciale ,et il ne distinguait pas entre les deux actes (presque tous les contrats de concession stipulés par le législateur sont des Affermages) , ceci en vue aux normes mises par le "Fiqh" et la justice française selon la création des services public c’est-à-dire faire la construction et le traitement. Et selon les données Algériennes actuelles ,et à la recherche d'autres solutions et moyens d'exploitation ;les contrats de concession peuvent se former l'un des méthodes de privatisation partielle de l'économie nationale, et l'un des moyens utilisés pour faire participer le secteur privé pour réaliser le développement.
