    رمت الافارازت التكنكلكجية بظلاليا عمى النشاطات البشرية ، بما فييا النشاطات التجارية التي أصبحت تتـ باستخداـ الكسائؿ التكنكلكجية ، فظيرت ما اصطمح عمييا التجارة الالكتركنية، كالتجارة الالكتركنية تتميز عف التجارة التقميدية في مختمؼ الجكانب، ك منيا جانب الاثبات الذم ىك مكضكع الدارسة ، فيككف إثبات العقد الالكتركني التجارم بكاسطة كسائؿ الكتركنية، كالذم يعد مف الكسائؿ السريعة كالتي اعترؼ بيا الفقو كالقضاء كالتشريع كذلؾ لاتماـ التصرؼ ك اثباتو، ك ىذا مف اجؿ ‌ كمنحيا الحجية القانكنية اللازمة في الاثبات ، الكصكؿ الى قكاعد عامة للاثبات الالكتركني في المعاملات التجارية. Technological advancements have cast their shadow over human activities, including: commercial activities These activities are now conducted using technological means, giving rise to what is termed electronic commerce Electronic commerce differs from traditional commerce in various aspects, including the aspect of proof, which is the subject of this study, the proof of an electronic commercial contract is done using electronic means, which are recognized by jurisprudence, judiciary, and legislation, and have been granted the necessary legal authority for evidence, in order to complete and prove transactions. This aims to establish general rules for electronic proof in commercial Transactions.
