دور القضاء في تسوية منازعات إثبات الملكية العقارية

Abstract

إن المراحل المختلفة التي مرت بها المنظومة العقارية وعدم وضوح النصوص القانونية، جعلت القضاء الجزائري يتصدى للنزاعات العقارية المتعلقة بمسألة إثبات الملكية العقارية والغاية من ذلك حمايتها وتنظيمها حيث تجسد ذلك من خلال الأحكام والقرارات القضائية الصادرة عن المحاكم وإجتهادات المحكمة العليا ومجلس الدولة. يؤول الاختصاص القضائي بالنظر في منازعات إثبات الملكية العقارية للقضاء العادي أو الإداري حسب طبيعة المناطق سواء كانت ممسوحة أو غير ممسوحة وكذلك بالنظر إلى نوعية النزاع وأطرافه. إن الحق العقاري في الجزائر ورغم تبني المشرع نظام الشهر العيني بقي مهددا بالنزاعات المختلفة مما يؤدي إلى عدم إستقرار الملكية، حيث يستوجب على المشرع مراجعة النصوص القانونية وخلق منظومة عقارية جديدة تتلائم مع المفهوم المتطور للعقار بإعتباره المحرك الأساسي للإستثمار الاقتصادي. The various stages in the real estate system and the lack of clarity in the legal texts have led the Algerian judiciary to deal with land disputes relating to the issue of the proof of real property, the purpose of which is to protect and regulate them. This is reflected in the judicial decisions and decisions of the courts and the jurisprudence of the Supreme Court and the Council of State. The jurisdiction to hear real property disputes shall be vested in the ordinary or administrative courts depending on the nature of the areas, whether or not they are erased, and also in view of the quality of the dispute and its parties. The right to real estate in Algeria, despite the adoption of the monthly regime in kind, has continued to be threatened by various conflicts, leading to the instability of property.
