مبدأ حرية الأسعار في قانون المنافسة الجزائري

Abstract

"كرس المشرع الجزاىري مبدأ حرية الأسعار في ظل القانون رقم 12/89 المتعلق بالأسعار كأول قانون جاء نتيجة الاصلاحات الاقتصادية ينص صراحة على هذا المبدأ، ثم صدر بعده الأمر رقم 06/95 المتعلق بالمنافسة ليأكده كذلك، ليلغي العمل به سنة 2003 بصدور الأمر رقم 03/03 المتعلق بالمنافسة المعدل و المتمم بالقانون رقم 12/08 المتعلق بالمنافسة و القانون رقم 02/10 المتعلق بالمنافسة الساري المفعول به إلى يومنا هذا. تهدف دراسة هذا البحث إلى ابراز الحماية الموضوعية لمبدأ حرية الأسعار من خلال النصوص القانونية التي نص عليها المشرع الجزائري صراحة في ظل الأمر رقم 03/03 و القانون رقم 02/04 المحدد للقواعد المطبقة على الممارسات التجارية و التطرق لدور الدولة الضابطة في هذا المجال، كما أن المشرع الجزائري منح لكل من مجلس المنافسة و القضاء العادي(المدني و الجزائي) دورا هاما و ذلك بتدخلهم في الحماية الجزائية لمبدأ حرية الأسعار." "The algerian legislator has enshrined in code 89/12 the principale of price freedom as the first law. It came as a result of economic reform. This law openly provides for this principale of price freedom, which has been confirmed by order 95/06. This principle of price freedom was only applied in 2003 following order 03/03,related to competition, amended and supplement by law 08/12 and law 10/05 valid unitl today. This study aims to highlight the objective protection of this principle through the legal texts that the algerian legislator has clearly stipulated in order 03/03 and law 04/02 which determine the specific rules of co.mercial practice.it also seeks to highlight the role of state control in this field. The algerian legislator has granted both the competition council and the ordinary justice a very important role through their interventions in the procedural protection of principle of freedom of prices."
