| dc.description.abstract | تعد الآليات السلمية لحل المنازعات الدولية من أهم الآليات كونها تجنب المجتمع الدولي الحروب والدمار ، ولهذا كان اختيارنا على الآليات القضائية ودورها في تسوية المنازعات الدولية البيئية كونها اخر الحلول السلمية التي تجنب المجتمع الدولي الخلافات والمنازعات المسلحة ،وهذه الآليات القضائية تتمثل في القضاء والتحكيم ومن هنا تطرق موضوعنا الى القضاء على المستويين الدولي والدولي الاقليمي وفصلنا في هاتين النقطتين بين القضاء العام والقضاء المتخصص ،وتوصلنا الى ان القضاء ورغم اهميته في حل المنازعات من خلال إصدار الأحكام والقرارات الا أنها تفتقد الى آلية لتنفيذها وبالتالي تبقى مفرغة من محتواها يضاف الى هذا ان المجتمع الدولى مازال لم يعط البيئة الأهمية التي تحتاجها وهذا من خلال قلة المنازعات التي تمت معالجتها عن طريق القضاء. | en_US |
