دور الضبط الإداري الصحي في ظل جائحة كورونا ( كوفيد19 )

Abstract

لقد تناولنا في د ا رستنا المعمقة هذه المعنونة ب: دور الضبط الإداري الصحي في ظل جائحة كورونا)كوفيد 19 ( , حيث تظهر أهمية الضبط الإداري في انه وسيلة للمحافظة على الصحة العامة وكافة عناصرها المكونة لها من مختلف الأض ا رر والمخاطر التي قد تصيبها ج ا رء نشاط بشري أو انتشار الأوبئة المعدية والمتنقلة, ونجد أن بعد انتشار فيروس كورونا)كوفيد 19 ) صدرت قوانين عديدة وم ا رسيم وتعليمات متنوعة كلها تدعو الى الحفاظ على الصحة العامة للبلاد من بينها المرسوم التنفيذي 20 / 69 المتعلق بالتدابير الوقاية من انتشار فيروس كورونا وكذا المرسوم 20 / 70 وما تبعه. حيث تمارس هذه الآليات من طرف هيئات على المستوى المركزي والمستوى المحلي, والإدارة مقيدة في ممارسة هذه الآليات الآن القانون هو الذي يحدد شروط وخصائص ممارستها. وقد تنوعت آليات أو وسائل الضبط الإداري في ظل جائحة كورنا في إطار حماية الصحة العامة بين آليات قانونية وأخرى مادية أي ردعية وهي بمثابة ج ا زء إداري.In our study, that entitled: The role of health administrative control in the Corona (Covid 19) pandemic, where the importance of administrative control that it is a means of preserving public health and all its constituent elements from the various damages and risks that may infect it as a result of human activity or the spread of epidemicsand by infectious diseases, and we find that after the spread of the Corona virus (Covid 19), many laws, decrees and instructions were issued, all calling for the preservation of the public health of the country, including Executive Decree 20/69 related to measures to prevent the spread of the Corona virus, as well as Decree 20/70 and what followed. Where these mechanisms are practiced by bodies at the central and local levels, and the administration is restricted to exercise these mechanisms, now the law determines the conditions and characteristics of their exercise. The mechanisms or means of administrative control in the period of the Corona pandemic in the context of protecting public health have varied between legal and material mechanisms, that is, deterrence, which is an administrative sanction.
