ضوابط تسوية الاشغال الغير مدرجة في الصفقة العمومية-دراسة تحليلية في التشريع الجزائري

Abstract

ملخص تهدف الدراسة إلى تحديد مضمون الأشغال الغير مدرجة في الصفقة العمومية و التي يلتزم المتعامل المتعاقد بتنفيذها تحقيقا لمتطلبات المنفعة العامة و ضمان حسن سير المرفق العام .كما تتناول الدراسة الحالات تلتزم التي فيها المصلحة المتعاقدة بتسوية الحقوق المالية الناتجة عن تنفيذ الأشغال الغير مدرجة في الصفقة لفائدة المتعامل المتعاقد،وتبيان الحدود التي وضعها المشرع لتحقيق العدالة المالية بين سلطات المصلحة المتعاقدة في توجيه الأوامر المصلحية بهذا الخصوص،و بين حق المتعامل المتعاقد في رفض الخضوع لهذه الأوامر أو قبولها و حقه في استفاء ما يقابل تنفيذها من مبالغ مالية إضافية . Abstract The purpose of the study is to determine the content of the work not planned in the public contract, which the holder is required to perform to ensure the proper execution of the work and the proper functioning of the public service. The study also deals with the cases in which the owner is obliged to pay, for the benefit of the owner, the financial rights resulting from the execution of the works not included in the contract, and indicates at the same time the limits established by the legislator. Aiming to maintain a fair balance between the service orders issued by the contracting service in this respect and the possibility for the holder to refuse or comply with these orders while retaining the right to receive additional remuneration
