التعاقد الإلكتروني في الصفقات العمومية كآلية للوقاية من الفساد

Abstract

لقد قام المشرع الج ا زئري بإستحداث آلية التعاقد الإلكتروني في إب ا رم الصفقات العمومية لحماية الصفقة العمومية من ج ا رئم الفساد المتفشية في هذا القطاع الحساس. وكل هاته الجهود المبذولة بغية مسايرة التطو ا رت التكنولوجية في العالم الوصول للرقمنة الكلية 221 و _ للإدارة و تحسين الخدمة العمومية، لهذا تبنى المرسوم الرئاسي الملغى رقم 92 217 التوجه للطريق الإلكتروني في إب ا رم الصفقات _ المرسوم المعمول به حاليا رقم 90 العمومية التي تتم ب واسطة الب وابة الإلكترونية المستحدثة بموجب الق ا رر الو ا زري المؤرخ في 97 نوفمبر 2292 التي تعد همزة الوصل بين المصلحة المتعاقدة والمتعاملين الإقتصاديين.The Algerian legislator has introduced the mechanism of electronic contracting in the conclusion of public procurements to protect the public procurement from corruption crimes rampant in this sensitive sector and all these efforts made in order to march technological developments in the world and access to the total digitization of the administration and improve the public service for this adopted the repealed presidential decree 10-236 and the decree currently in force No. 15-247 to go to the electronic route in the public procurements that are carried out through the electronic portal created by the ministerial decision dated17 November 2013 Which is a link between the contracting authority and economic operators.
