أثر الرابط الأسري على عقوبة الجرائم الواقعة على الأسرة - دراسة مقارنة بين الفقه الإسلامي وقانون العقوبات الجزائري

Abstract

"تهدف هذه الدراسة إلى مسألة أساسية ألا وهي إظهار أثر الرابط الأسري وأهميته على توقيع العقوبات على الأسرة ومدى مساهمته في تغيير هذه العقوبات إما بالتشديد أو التخفيف من حدتها، وذلك من خلال طرح الإشكالية الآتية: ما مدى مساهمة الرابط الأسري في التأثير على عقوبة الجرائم الواقعة داخل الأسرة؟""، وتمت معالجة هذه الإشكالية من خلال التطرق إلى جميع الجوانب المتعلقة بها باستعمال المنهج الاستقرائي والمنهج المقارن، وبالاعتماد على مجموعة من المراجع والدراسات السابقة، إلى أن توصلنا لمجموعة من النتائج نذكر من أهمها أن الرابط الأسري قد يكون كسبب للإعفاء من العقاب، أو أن يكون عذرا مخففا في حين، وقد يكون أيضا ظرفا مشددا كما في جرائم قتل الأصول.
