Abstract

تك م ن أهمية هذا البحث الموسوم ب: دور اُلقاضي اُلإداري فُي مُنازعات اُلتعويض عُن نُزعُ الملكية لُلمنفعة اُلعمومية إُلى إب ا رز فعالية ودور القاضي الإداري في رقابته على مدى احت ا رم الإدارة النازعة للملكية للضمانات المقررة لحماية حقوق الشخص المطلوب نزع ملكيته، ويذلل المع وقات المادية التي تمنع الإدارة من حيازة الممتلكات، كما أن الغاية المنشودة هي تحقيق تعويض عادل ومنصف، وحتى يتسنى تحقيق تلك الغاية المرجوة اقتضى منا تقسيم هذا البحث إلى مقدمة وفصلين وخاتمة اشتملت على أهم النتائج. كما اشتملت هذه الد ا رسة على جملة من النتائج ملخصة كما يلي: - أن المشرع لم يهتم بدور القاضي الإداري في رقابته على إج ا رءات التعويض في مجال نزع 11 وذلك بعدم تطرقه إلى منازعات / الملكية، وهذا ما يظهر جليا من خلال قانون 91 التعويض، بما فيها الجهة القضائية المختصة بالنظر في المخاصمة والإج ا رءات المتبعة لتحديد التعويض، والأسس والمعايير لتحديد تعويض عادل ومنصف. - يلجأ القاضي الإداري إلى القواعد العامة لتحديد التعويض في مجال نزع الملكية معتمدا في ذلك إج ا رءات التحقيق في المواد المدنية، المتمثلة أساسا في الخبرة بواسطة الخبير العقاري والانتقال لمعاينة الأمكنة من طرف القاضي الإداري. - أن القاضي الإداري الج ا زئري غير مختص في المواد العقارية، فيصعب عليه تحقيق العدل والإنصاف في التعويض. فرغم نص المشرع أن التعويض في مجال نزع الملكية يكون قبلي، عادلا ومنصفا إلا أنه لم يوفر آليات تحقيق هذا التعويض.The importance of this research tagged with: The role of the administrative judge in compensation disputes for expropriation for the public benefit is to highlight the effectiveness and the role of the administrative judge in his oversight of the extent to which the expropriating administration respects the guarantees established to protect the rights of the person required to be expropriated, and it overcomes the material obstacles that prevent the administration from acquiring property Also, the desired goal is to achieve fair and equitable compensation, and in order to achieve that desired goal, it required us to divide this research into an introduction, two chapters and a conclusion that included the most important results. This study also included a number of results summarized as follows: - The legislator did not care about the role of the administrative judge in his oversight of compensation procedures in the field of expropriation, and this is evident in Law 91/11 by not addressing compensation disputes, including the judicial authority competent to consider litigation, the procedures followed to determine compensation, the bases and standards To determine fair and equitable compensation. - The administrative judge resorts to the general rules to determine compensation in the field of expropriation, relying on the investigation procedures in civil matters, which are mainly expertise by the real estate expert and moving to inspect the places by the administrative judge. - The Algerian administrative judge is not specialized in real estate matters, so it is difficult for him to achieve justice and fairness in compensation. Although the legislator stipulates that compensation in the field of expropriation is tribal, just and equitable, it did not provide the mechanisms for achieving this compensation
