إشكالية التنازل عن السكنات الوظيفية

Abstract

من خلال د ا رستنا لموضوع المذكرة تبين لنا بأن المشرع الج ا ز ئ ري عمل جاهدا لتحسين الظروف المحيطة بالموظف لتحسين الأداء الوظيفي خصوصا فيما يتعلق بالسكن الوظيفي أين صدرت عدة نصوص تشريعية متعلقة بموضوع السكنات الوظيفي، سيما القانون 81 / 01 والمرسوم التنفيذي 89 / 10 اللذان يعدان من أهم النصوص القانونية المعتمد عليها في عملة التنازل وكذلك في تحديد شروط وكيفية التنازل عن السكنات الوظيفية والتي تخضع لإج ا رءات خاصة وتشرف عليها لجان وجهات مختصة. وهو ما يؤدي غالبا إلى قيام عدة إشكاليات أمام الجهات الإدارية وكذلك قيام منازعات أمام الجهات القضائية والتي يعد القضاء الإداري الجهة القضائ ية المختصة في الدعاوى المرفوعة بناء على المعيار العضوي الذي ا عتمد عليه المشرع في تحديد جهة الا ختصاص بشكل أساسي رغم تعدد أنواعها القضايا نظ ا ر لطبيعة المنازعة والحق المطالب به أمام الجهة القضائية المختصة.Through our study of the subject matter of the memorandum, it is clear to us that the penal legislator has worked hard to improve the conditions surrounding the employee to improve the job performance, especially with regard to occupational housing, where several legislative texts have been promulgated on the subject of occupational housing. In particular, Act N° 81/01 and Executive Decree N° 89/10, which are two of the most important legal texts relied upon in the currency of the waiver, as well as in determining the conditions and manner of the waiver of occupational housing, which are subject to special procedures and are supervised by committees and competent bodies. This often leads to a number of problems before the administrative authorities, as well as disputes before the judicial authorities. The administrative judiciary is the competent judicial authority in proceedings brought on the basis of the organic criterion on which the legislator relied in determining the jurisdiction essentially despite the variety of cases due to the nature of the dispute and the right claimed before the competent judicial authority.
