إجراءات الصلح والوساطة وفقا لقانون الإجراءات المدنية والإدارية

Abstract

تماشيا مع ما تفرضه التطورات الاجتماعية والاقتصادية وما يترتب عليها من منازعات قام المشرع الجزائري بتفعيل سياسية العدالة الرضائية الى جاني العدالة القضائية ضمن قانون الإجراءات المدنية والإدارية 08-09 حيث الزم القاضي بعرض إجراء الوساطة او الصلح على الخصوم. وفي إطار تفعيل هذه السياسة كطريق بديل لتسوية المنازعات ودياً وخاصة تلك المتعلقة بالتجارة الوطنية والدولية صدر القانون 22-13 المعدل والمتمم لقانون الإجراءات المدنية والإدارية الذي استحدث محاكم تجارية متخصصة وقيد إجراءات التقاضي أمامها بإجراء الصلح كقيد إجباري لرفع الدعوى، كذلك أحدث تعديلات على مستوى القسم التجاري أين أصبح اجراء الوساطة إجباري قبل بدء إجراءات الدعوى القضائية، سعيا منه لتبنى نظام قضائي تجاري يكون الخيار الأول للتجار المتقاضيين بعيداً عن بطئ الإجراءات وعلانية الجلسات. In line with the social and economic developments and the resulting disputes، the Algerian legislator has activated a policy of consensual justice alongside judicial justice within the Civil and Administrative Procedure Code 08-09، where the judge is obliged to propose mediation or conciliation to the parties. As part of implementing this policy as an alternative method for amicably resolving disputes، especially those related to national and international trade، Law 22-13 amending and supplementing the Civil and Administrative Procedure Code was enacted. This law introduced specialized commercial courts and made the conciliation procedure a mandatory prerequisite for filing a lawsuit. Additionally، it implemented changes in the commercial division، where mediation has become mandatory before initiating litigation procedures، aiming to adopt a commercial judicial system that serves as the first choice for litigating traders، away from the slow procedures and public hearings.
