حجاجية الخطاب القضائي في محاكم ولاية قضايا الطلاق أنموذجا

Abstract

تناولت هذه الدّراسة حجاجيّة الخطاب القضائي في محاكم ولاية الوادي - المتعلّق بقضايا الطلاق – و تهدف إلى الوقوف على مدى حجاجيّة هذا النّمط من الخطاب ، و الكشف عن الآليّات الحجاجيّة التي توظّفها الأطراف المتخاطبة . حيث بدأت بمقدمة ،يليها تمهيد ، قدّمت فيه المفاهيم الأوّليّة للحجاج و الخطاب القضائي لفكّ الرّابطة الزّوجيّة، و جاء البحث في ثلاثة فصول ، تمّ التّنظير و التطبيق لكل فصل في آن واحد . الفصل الأول : تناول الآليّات الحجاجيّة اللّغويّة . الفصل الثاني : تناول الآليّات و التّقنيّات الحجاجيّة البلاغيّة ، وفيه قسمين ، ضمّ الأوّل الآليّات البلاغيّة من منظور البلاغة الكلاسيكيّة، فيما ضمّ الثّاني التّقنيّات البلاغيّة من منظور البلاغة الجديدة لبيرلمان و تيتيكا . الفصل الثالث :تناول الآليّات الحجاجيّة شبه منطقيّة السّلميّة و غير السّلميّة. و ختمت الدّراسة بخاتمة ضمّت أهمّ النّتائج المتوصّل إليها . The current study deals with the judicial discourse and to what extent this type of discourse is argumentative, in the courts of El-oued district concerning divorce cases. It aims to determine the extent to which this discourse is argumentative and analyses the argumentative mechanisms used by the discourse participants.The research starts with an introduction, followed by a preface, in which the preliminary concepts of the judicial discourse to marriage dissolution were presented. The study is divided into three chapters, each chapter is devoted to its theotrical and practical parts. The first chapter studies the linguistic argumentative mechanisms. The second chapter deals with the rhetorical argumentative mechanisms and techniques . It is divided into two parts .The first deals with the rhetorical mechanisms from the classical rhetoric perspective, but the second studies it according to the modern rhetoric of Liberman and Teteka . The third chapter studies scales and non-scales logical mechanisms. We conclude with the founded results.
