| dc.description.abstract | دف هذه الدراسة حول إعطاء الإطار المفاهيمي للمكية العقارية الخاصة في التشريع الجزائري و الحماية الجنائية ، إذ أن الملكية العقارية الخاصة تمنح لصحاا سلطة علي الشيء تمكنه وحده مـــــن استعماله واستغلاله والتصرف فيه في حدود القانون و بما أن الملكية تعتبر الركيزة الأساسية التي يعتمد عليها الدول في اقتصادياا وتوجهاا السياسية لما له من أثر بالغ في صناعة القرار و خلق الثروة، فقد أصبغ عليه المشرع هذا النوع من الحماية ، فالملكية العقارية تحضي بأهمية كبيرة في مختلف الدساتير الحديثة فهو حق مكفول دستوريا ، أما الحماية الجنائية فهي نوع من الحماية القانونية لهذا جاء قانون العقوبات يحمي مصالح الغير عن طريق تقرير الجزاء المناسب علي المعتدي ، لهذا وسيلة القانون الجنائي تتمثل في حماية حقوق الغي. | en_US |
