قاعدة مراعاة الخلاف وتطبيقاتها في أحكام الأسرة

Abstract

الملخص: هذه الدراسة بعنوان: "قاعدة مراعاة الخلاف وتطبيقاتها في أحكام الأسرة - دراسة مقارنة في الشريعة والقانون"، إشكالها الرئيس الذي تسعى للإجابة عنه هو: ما مدى حضور قاعدة مراعاة الخلاف في قانون الأسرة الجزائري والاجتهاد القضائي للمحكمة العليا؟ أجابت الدراسة عن ذلك من خلال ثلاثة فصول؛ فصل نظري وفصلين تطبيقيين، خُصِّصَ الفصل الأول لحقيقة قاعدة مراعاة الخلاف وما يتعلق بها، ولتعريف الأسرة والتقنين والاجتهاد القضائي، ولمصادر قانون الأسرة الجزائري، وجُعِلَ الفصل الثاني لتطبيقات القاعدة في إنشاء الزواج وآثاره، وتناول الفصل الثالث تطبيقات القاعدة في انحلال الزواج وآثاره. وتوصلت الدراسة لجملة من النتائج لَعَلَّ من أهمها أن الخلاف الفقهي أمر مشروع في الفقه الإسلامي دلت عليه النصوص والقواعد، كذلك تَرَجَّحَ من خلال بيان مدلول قاعدة مراعاة الخلاف أنها انتقال المجتهد إلى قول غيره من المجتهدين لمسوِّغ، وذلك بهدف الترجيح بين الأقوال الفقهية المختلفة، واختيار أنسبها للتقنين التشريعي والتطبيق القضائي، وترجيح أليقها بتحقيق مقاصد التكليف كرفع الحرج وجلب المصالح ودرء المفاسد وغيرها، وهي نوعين مراعاة قبل وقوع الفعل أو المراعاة الكلية، ومراعاة بعد وقوع الفعل أو المراعاة الجزئية، كذلك من خلال استقراء نصوص قانون الأسرة الجزائري وقرارات الاجتهادات القضائية للمحكمة العليا تم تجميع جملة من المسائل الفقهية التي تعتبر كنماذج لتطبيقات قاعدة مراعاة الخلاف في مسائل الزواج وآثاره، و كذلك الأمر في مسائل انحلال الزواج وآثاره.

Résumé : This study is entitled: “The rule of taking into account disagreement and its applications in family rulings - a comparative study in Sharia and law”, its main problem that it seeks to answer is: To what extent is the rule of taking into account the dispute present in the Algerian family law and the jurisprudence of the Supreme Court? The study answered this through three chapters; An theoretical chapter and two applied chapters. The first chapter is devoted to the reality of the rule of consideration of disagreement and what is related to it, the definition of the family, codification and jurisprudence, and the sources of Algerian family law. The second chapter is devoted to the applications of the rule in establishing marriage and its effects, and the third chapter to the applications of the rule in the dissolution of mariage and its effets. The study reached a number of results, perhaps the most important of which is that the jurisprudential dispute is a legitimate matter in Islamic jurisprudence indicated by the texts and rules. Legislative codification and judicial application, and weighting its appropriateness to achieve the purposes of the assignment such as lifting embarrassment, bringing interests and warding off corruption and others. Among the jurisprudential issues that are considered as models for the applications of the rule of taking into account the dispute in matters of marriage and its effects, as well as in the issues of dissolution of marriage and its effects.
