أحكام انتقال التركة العقارية في التشريع الجزائري

Abstract

الشهادة التوثيقية هي الأداة القانونية التي يتم بموجبها شهر حق الإرث لما يتعلق الأمر بالملكية العقارية أو حقوق عينية عقارية، و تنتقل بشكل قانوني إلى الورثة يوم الوفاة، شرط أن يكون تحريرها من طرف موثق، وذلك بطلب من أصحاب الحق، وهذا الإجراء القانوني سبب جدلا واسعا حول مدى أهميته بالنسبة للورثة، وعلاقته بعملية انتقال التركة العقارية، ودوره أمام القضاء في حالة ما يثار نزاع فيما بين الورثة أو بين الورثة والغير. Abstract : The attestation certificate is the legal instrument through which the right of inheritance regarding property or real property rights is certified. It legally transfers to the heirs upon the death, except by being issued by the notary, upon the request of the rightful owners. This legal procedure has sparked extensive debate about its importance for the heirs and its relationship to the process of transferring inherited property ownership, as well as its role in case of disputes between the heirs or with third parties.
