انظمة التحفيز المالي لجذب المستثمرفي ظل قانون 18/22

Abstract

تهدف الدراسة إلى تحليل أنظمة التحفيز في الجزائر لجذب المستثمرين، مع التركيز على قانون 22-18 الذي يعد من القوانين الهامة تهدف إلى تحسين بيئة الاستثمار من خلال استحداث المشرع الجزائري تقسيما ثلاثيا للنظام التحفيزي الموجه للاستثمار وهي نظام القطاعات ونظام المناطق ونظام الاستثمارات الهيكلة، وما تضمنه كل نظام من عديد التحفيزات سواء بالنسبة لمرحلة الانجاز، أو لمرحلة الاستغلال، من إجراءات تحفيزية واعفاءات ضريبية وجمركية والكثير من التسهيلات لاستقطاب المستثمرين، وتوفير مناخ مناسب لهم سواء كانوا وطنيين أو أجانب، ومن ثم ارتباط حق الاستفادة منها بشروط وجب أن يستوفيها المشروع الاستثماري من شروط شكلية وأخرى موضوعية.

The study aims to analyze the incentive systems in Algeria to attract investors, focusing on Law 22-18, which is one of the important laws aimed at improving the investment environment. The Algerian legislator has introduced a tripartite division of the incentive system directed at investment, which includes the sectoral system, the regional system, and the structured investments system. Each system contains various incentives for both the implementation phase and the operational phase, including incentive measures, tax and customs exemptions, and many other facilitations to attract investors and provide a suitable climate for them, whether they are national or foreign. The right to benefit from these incentives is contingent upon the investment project meeting both formal and substantive conditions.
