دور السلطة الوطنية المستقلة للانتخابات للحد من الجرائم الانتخابية

Abstract

مند تأسيس الدولة الجزائرية في سنة 1962 بعد معاناة من المستعمر اخذت الدولة الجزائرية على عاتقها بناء دولة ذات مؤسسات دستورية تحرص على اشباع حاجيات المواطن بكل شفافية من خلال هذه الاخيرة و عليه التزمت السلطة با شرعنه كل التصرفات التي تخص مرافقة الدولة للمواطن و علية ثم استحداث السلطة الوطنية المستقلة للانتخابات من اجل محاربة كل محاولة للنيل من مؤسسات الدولة والزمها المشرع الجزائري بجملة من الصلاحيات التي من شانها تحمي حقوق الشعب مع مشاركة هذا الاخير في قرارات المتخذة من طرف السلطة و عليه تقوم السلطة بمحاربة كل اشكال التحريف و اتزوير و الجرائم المحتملة الحدوث في كل مراحل العملية الانتخابية من خلال ترسانة من العقوبات تحد و تردع كل من يتجرءا في العبث بالمؤسسات الدولة و العمل على عرقلة نظام الشفافية الذي اعتمدته الدولة في اشراك الشعب في الحياة السياسية . و منه يتضح تأكيد المشرع الجزائري على مرافقة العملية الانتخابية في جميع مراحلها . و كذا تجريم كل ما يخيل بسير هذه العملية كذلك التشديد في كل العقوبات المقررة في هذا لشان في حالة توفرت الظروف لذلك سواء ناخب او مرشح او اي شخص اداري . Since the establishment of the Algerian state in the year 1962, after suffering from the colonialists, the Algerian state has taken it upon itself to build a state with constitutional institutions that are keen to satisfy the needs of the citizen in full transparency through the latter, and the authority is committed to legitimizing all actions related to the state’s accompaniment to the citizen and his cause, and then the creation of power The Independent National Elections Committee, in order to combat every attempt to undermine state institutions, and the Algerian legislature committed it to a set of powers that would protect the rights of the people with the participation of the latter in the decisions taken by the authority, and accordingly the authority fights all forms of distortion, fraud and possible crimes in every country. The stages of the electoral process through an arsenal of penalties that limit and deter anyone who dares to tamper with state institutions and work to obstruct the transparency system adopted by the state in involving the people in political life. And it is clear from it the Algerian legislator's emphasis on accompanying the electoral process in all its stages. Likewise, the criminalization of everything that imagines the progress of this process, as well as the tightening of all penalties prescribed in this matter, in case the conditions are available for that, whether it is a voter, a candidate, or any administrative perso.
