الرقابة القضائية على تدابير الضبط الإداري في الجزائر

Abstract

لقد استيدفت د ا رستنا لموضوع الرقابة القضائية عمى تدابير الضبط الإداري في الج ا زئر, سعيا منا لموقوف عمى معالم ىذه الرقابة التي تشكل ضمانة حقيقية لحرية الأف ا رد, وقد حددنا مضمون ىذه الرقابة في بحثنا من خلال دعوى الإلغاء وقد درسنا ىذه الرقابة وفقا لمرقابة محل الشرعية الداخمية لق ا ر ا رت الضبط الإداري والرقابة عمى الشرعية الخارجية وكذا الانح ا رف بالسمطة . فمن خلال الد ا رسة أ رينا أن الضبط الإداري ىو عبارة عن تدابير تتخذىا السمطات المخولة قانونا لممارسة ضبط الإداري, بيدف تحقيق حفظ النظام العام أو إعادتو بعناصره الثلاث, وقد لاحظنا مدى أىمية الضبط الإداري في حياة المواطنين ومدى أىميتو ولزومو لممحافظة عمى النظام العام بصفة عامة. أما أىم نتيجة وصمت إليو ىيا ضرورة تفعيل دور القضاء في الرقابة عمى تدابير الضبط الإداري والحزم في ق ا ر ا رتيا, وذلك من خلال تفعيل دور المشرع الج ا زئري لسد الثغ ا رت القانونية وكذا تعديمو وفقا لما يطابق الواقع المعاش. Nous avons ciblé notre étude du sujet du contrôle judiciaire sur les mesures de contrôle administratif en Algérie, afin de déterminer les paramètres de ce contrôle qui constituent une véritable garantie de la liberté des individus, nous avons identifié le contenu de ce contrôle dans notre recherche à travers le cas d'annulation, nous avons examiné ce contrôle en fonction du contrôle de la légitimité interne des décisions de l'atelier de contrôle administratif et le contrôle de légitimité externe ainsi que la déviation de puissance. Grâce à l'étude, nous avons vu que le contrôle administratif est une autorité de mesure prise délégué par la loi à exercer un contrôle administratif afin d'obtenir le maintien de l'ordre public ou retourner les trois Banazare, nous avons remarqué l'importance du contrôle administratif dans la vie des citoyens et l'étendue de son importance et être nécessaire pour maintenir l'ordre public en général. Our study focused on the judicial control of administrative control measures in Algeria, in order to establish the parameters of this control which constitutes a real guarantee for the freedom of individuals. We have determined the content of this censorship in our research through the cancellation proceedings. And the control of external legitimacy as well as deviation in power. In the course of the study, we have seen that administrative control is a measure taken by the authorities, which are legally authorized to exercise administrative control, in order to achieve the preservation of the public order or to return it to its three elements. We have noted the importance of administrative control in the lives of citizens and its importance and its need to maintain public order in general.
