Abstract

تتناول هذه الدراسة موضوع وضعية الموظف العام حيال القانون وذلك كدراسة قانونية مقارنة بين الأحكام الواردة في القانون الإداري والقانون الجنائي , وتحاول الدراسة من خلال ذلك تبيان تحديد مركز الموظف العام , الذي يتبوءه في إطار الأمر ) 06 / 03 ( والقانون ) 06 / 01 ( مكانة أساسية مساهمة في تطوير المرفق العام بما يحقق نجاعته . فمن المنطلق جاء البحث ليسلط الضوء على المركز القانوني للموظف العام , وليعالج مدى التباين والتوافق ويكشف عن حجم التغاير والتأثير بينهما , في حالة ما إذا ارتكب فعلا يخل بكرامة الوظيفة التي تعرضه للمساءلة التأديبية والجزائية , كونه معبر عن إرادة الدولة ومطلع على أسرارها التي منحت له صفة الموظف. تضمن البحث العديد من الأفكار و ال راء التي نعتقد أنها تبين جليا مكانة الموظف العام بين كلا القانونين ويتضمن أيضا خاتمه احتوت على بعض النتائج والمقترحات التي يث رى بها الموضوع كمساهمة منا.This study deals with the topic of the position of the public employee vis-à-vis the law as a comparative legal study between the provisions contained in the administrative law and the criminal law, and the study attempts through that to indicate the determination of the position of the public employee, which he occupies within the framework of the order (06/03) and the law (06/01) standing An essential contribution to the development of the public utility to achieve its efficacy.
