القواعد الإجرائية الحديثة لمواجهة الجرائم الاقتصادية والمالية

Abstract

في بحثنا العلمي، قمنا بدراسة موضوع قانوني يتعلق بالإجراءات الحديثة التي تم تبنيها من قبل المشرع لمكافحة الجرائم الاقتصادية. حيث تعد الجريمة الاقتصادية واحدة من اخطر الجرائم التي تستهدف اقتصاد الدول، وتؤثر على مختلف الثروات من خلال استنزافها واختلاس المال حيث تؤثر سلبي على حركة النمو والتوازن الاقتصادي، ولذلك تسعى التشريعات المختلفة لمكافحة وقمع هذا النوع من الجرائم. حيث تسعى التشريعات جاهدة لمكافحة هذه الجرائم كما نجد التشريع الجزائري من هذه التشريعات من خلال تنظيمها وتنظيم عقوباتها بوضوح والقضاء عليها. ونتيجة لذلك تم إنشاء القطب الجزائي الاقتصادي كهيئة قضائية جديدة لمكافحة الجريمة سواء من خلال اتخاذ إجراءات قانونية أو باستخدام أساليب خاصة للتحقيق والبحث التي تم تضمين بعض القواعد والضوابط التي تنظم هذه الإجراءات لتجنب انتهاك خصوصية الأفراد. وبالإضافة إلى ذلك، يتمتع وكلاء الجمهورية وقضاة التحقيق والحكم في القطب الجزائي الاقتصادي بخبرة متخصصة في مجال هذه الجرائم، ولديهم تدريب خاص ومميز في مختلف الإجراءات، وخاصة تلك ذات طابع فني In our scientific research, we studied a legal topic related to modern measures that have been adopted by the legislator to combat economic crimes. Economic crime is one of the most dangerous crimes targeting the economy of countries, and affects various types of wealth through depletion and embezzlement of money, as it negatively affects growth and economic balance. Therefore, various legislation seeks to combat and suppress this type of crime. Legislation strives to combat these crimes, as we find in Algerian legislation, by regulating them, clearly regulating their penalties, and eliminating them. As a result, the Economic Penal Pole was established as a new judicial body to combat crime, whether by taking legal measures or using special methods of investigation and research, in which some rules and regulations were included that regulate these procedures to avoid violating the privacy of individuals. In addition, the public prosecutors, investigative judges and arbitrators at the economic penal pole have specialized expertise in the field of these crimes, and have special and distinct training in various procedures, especially those of a technical nature.
