Abstract

إنموضوع الالتزام بالقواعد الدستورية هو أحد أهم الموضوعات القانونية التي أولاها رجال الفقه الدستوري الاهتمام الكبير حيث احتل هذا الموضوع مكانة رفيعة في مختلفدراساتهم وأبحاثهم لما له من أهمية بالغة كونه على صلة وثيقة بما يعرف بدولة الحق والقانون، حيث تتجلى مظاهر الضمانات القانونية لاحترام رئيس الجمهورية للمبادئ الدستورية في مواجهة السلطة التشريعية والسلطة القضائية في الوسائل والإجراءات الرقابية العديدة التي يملكها أعضاءالبرلمان تجاه الحكومة التي يعينها رئيس الجمهورية وكذا في الخيانة العظمى كآلية للمسؤولية الجنائية لرئيس الجمهورية في الدستور الجزائري لسنة 1996 والتي ذكرها تحديدا في المادة 158، إلى جانب الضمانات القانونية لالتزام رئيس الجمهورية بالقواعد الدستورية، هناك ضمانات واقعية غير منظمة تعزز دور الضمانات القانونية التي قد تعجز أحيانا عن توفير الحماية اللازمة للدستور واحترام حقوق الأفراد وحرياتهم، وتتمثل هذه الضمانات في رقابة الرأي العام ومقاومة ؿ الطغياا لتيتعدضمانةأساسيةضدكلاستبدادمنا لسلطات الحاكمة وخروجمنهاعلى الأحكام الدستورية.
