التنمية المستدامة وفق قانون الاستثمار للبلدية

Abstract

يمكن ان نلخص هذه المذكرة في بعض الأسطر : ان مدلول الاستثمار لتحقيق التنمية المستدامة وفق قانون البلدية في الجزائر فهي مجسدة فعليا منذ ان نالت الجزائر استقلالها وجسدت ذلك من خلال ما تعهد به تلك الطليعة من قادة الثورة في بيان أول نوفمبر 1954 إقامة دولة اجتماعية في اطارالمبادئ الإسلامية . ورغم ما واجهته الدولة وكل مؤسساتها الدستورية وبالأخص ما واجهته البلديات من تحديات من جراء الاستعمار من تدمير شامل لكل القدرات إلا أنها سارعت وسابقت الزمن بان وضعت خططا للتنمية الشاملة بغية تحقيق تنمية مستدامة مكرسة في كل مواثيقها الدستورية سواء في حقبة الأحادية الحزبية آو زمن التعددية ولم تأنى بنفسها ان تخلت البلديات في انجاز أي تنمية وفق كل أساليب التنمية بحيث بداية من التسيير الذاتي للمؤسسات ومنها المستثمرات الفلاحية إلى التسيير الاشتراكي للمؤسسات إلى تكريس نهج المخططات التنموية الثلاثية والرباعية والخماسية دون نسيان ان البلديات مانصت عليه كل القوانين والتنظيمات ذات الصلة بها إلا عملت كل المجالس المنتخبة والمعينة بما هو واجب رغم نقص الإمكانيات المادية والبشرية عبر مسارها منذ الاستقلال إلى هذا التاريخ ورغم ما تواجهه من تحديات واقعية وخاصة من إدارة الوصاية بصفة خاصة . مما نأمل ونطلع من الهيئة التشريعية ان تصدر قانونا جديدا يكرس متطلبات المرحلة ومما تنشده الساكنة في بلدية من بلديات الوطن وفق كل طبيعة ومواطني أي بلدية والتخلي عن نهج المركزية التوجيهية والتنفيذية . لتكون في مستوى تطلعات ساكنها وفق طبيعتها وامكانياتها الفعلية البشرية والمادية لتكون في مستوى تطلعات ساكنها لتحقيق تنميتها الفعلية والمستدامة المنشودة . We can summarize this memo in a few lines: The concept of investment to achieve sustainable development according to the municipal law in Algeria has been effectively embodied since Algeria gained its independence. This was realized through the commitments made by the vanguard of revolution leaders in the Declaration of November 1, 1954, to establish a social state within the framework of Islamic principles. Despite the challenges faced by the state and all its constitutional institutions, particularly the municipalities, due to the comprehensive destruction caused by colonialism, the state hurried and raced against time by setting up comprehensive development plans aimed at achieving sustainable development enshrined in all its constitutional charters, whether during the era of one-party rule or the time of pluralism. __ The municipalities did not refrain from undertaking any development according to all development methods, starting from the self-management of institutions, including agricultural investments, to the socialist management of institutions, to the adoption of three-year, four-year, and five-year development plans. It should not be forgotten that all laws and regulations related to municipalities have stipulated that all elected and appointed councils work dutifully despite the lack of material and human resources throughout their history since independence until now, and despite facing real challenges, especially from the supervisory administration. __ We hope and look forward to the legislative body issuing a new law that enshrines the requirements of the current stage and meets the aspirations of the residents of any municipality in the country, according to the nature and citizens of each municipality, and abandoning the approach of centralized directives and execution. This will allow municipalities to meet the expectations of their residents according to their actual human and material capacities, in order to achieve the desired actual and sustainable development
