منهج الإمام أبي العرب محمد بن أحمد بن تميم القيرواني في الجرح و التعديل

Abstract

تناول الباحث في هذه الدراسة والموسومة بمقاصد العمران في الشريعة الإسلامية مصطلحي "المقاصد" و "العمران" بالتعريف اللغوي، الاصطلاحي والإضافي، كما بين إعمال الشرع للمقاصد، وتتبع التطور التاريخي للبحث المقاصدي. وقبل بيان مشروعية العمران في الكتاب والسنة والفقه، استعرض بعض ما ورد في القرآن مقرونا بلفظ "عمران" وما تعلق به وبعدما تعرض المقاصد العمران المتعلقة بالضروريات والحاجيات والتحسينيات، قام باستخلاص بعض ضوابطها المقاصدية، ثم اختبر مراعاة بعضها على مستوى تاريخ العمارة الإسلامية، التشريع العمراني الجزائري، والهندسة المعمارية الحديثة، وتوصل في الأخير إلى أن مقاصد العمران هي المعاني والحكم التي راعاها الشارع في التشريع العمراني من أجل تقرير عبودية الله ومصلحة الإنسان في الدارين، وإلى أن الضوابط المقاصدية للعمران هي القواعد المحترمة في محال العمران والبناء لتحقيق فحوى مراتب المصالح الثلاث، بغض النظر عن شكل العمارة، فإن تدافعت هذه المراتب قدم الضروري منها على الحاجي والحاجي على التحسيني مثل ما حدث في العمارة الإسلامية التقليدية، فإن أمكن تحصيلها جميعا دون تدافع فذلك المبتغى، والتقنيات المعمارية الحديثة حققته بكفاءة عالية، وهذا ما يستدعي تقنينا معماريا جديدا يتماشى والمقاصد الشرعية، يجمع بين الدين والدنيا، بين الآخرة والأولى. Résumé Praise be to God and prayers and peace be upon the Messenger of Allah and his family and companions. Summary of the thesis: I talked in my thesis about the approach of Imam Abu al-Arab Mohammed bin Ahmad al-Qayrawani in wound and justice, so I gave him a definition of his person and his time in which he lived, highlighting his modern personality by praising the scholars and mentioning the most important of his books in that, his impact from the one that came after him from the modernists, and then addressed his approach in the I studied sixty examples of the narrators in which i quoted the words of Imam Abu al-Arab and compared him to others through the ages and concluded by judging each narrator, and summarized his method in amending and the ranks of the two modifiers, and then dealt with his approach in the wound by studying seventy narrators quoted in them the words of Imam Abi al-Arab and compared him to others.
