Abstract

تطرقت الدراسة إلى واحد من أهم الموضوعات التي تخص علاقات العمل ألا وهو حق العامل في الاستقالة في ظل قانون 90-11 المعدل والمتمم معتمدين في ذلك على النصوص التشريعية واجتهادات الفقهاء و شراح القانون الذي كان لهم الدور البالغ الأثر في معالجة هذا الحق, لما له من أهمية لأنها الثابت الذي يحافظ على كرامة العامل في إطار المحافظة ومراعاة مجمل الشروط والآثار القانونية المترتبة أي حدود هذا الحق.The study touched on one of the most important issues related to labor relations, which is the worker’s right to resign under the amended and supplemented Law 90-11, relying on legislative texts and the jurisprudence of jurists and law commentators, who had a very influential role in addressing this right, because of its It is important because it is the constant that preserves the dignity of the worker within the framework of the governorate and taking into account the totality of the conditions and the legal effects resulting from any limits of this right
