ودوره في تسيير الشركات المختلطة الاقتصاد في الجزائر

Abstract

عقد المناجمنت عقد نابع من عالم الأعمال وهو حديث النشأة, كانت بداية ظهوره في أمريكا ثم لاقى انتشارا في جميع أنحاء العالم لما له من نجاعة وتأثير في حل مشكلات الدول من ناحية تسيير مؤسساتها و دحض العراقيل و الحواجز التي تحد من نموها, هذا لما ينفرد به من خصوصيات تميزه عن غيره من العقود من بينها تحويل السلطة و رفع المردودية المالية والاقتصادية, اضافة الى تطوير الشركات واصباغها بالتكنولوجيا الحديثة مع نقل المعرفة الفنية والتقنية. هذا ما وجده المشرع الجزائري يتماشى مع متطلباته خلال المرحلة الانتقالية التي مرت بها البلاد حينها, فقرر استقطاب عقد المناجمنت واحتوائه في منظومته القانونية وذلك بتخصيص عشرة مواد له حددت احكام تطبيقه بهدف تأطير عملية تسيير الشركات المختلطة الاقتصاد والمؤسسات العمومية الاقتصادية الناتجة عن هذا العقد, اذ انه بمجرد انعقاده يبدأ سريان اثاره بنسبة لكل من طرفيه اللذان اذا نفذا التزامهما على اكمل وجه وبحسن نية, ساهم ذلك في تحسين سير الشركات المختلطة الاقتصاد في الجزائر وهو ما اثبتته واكدت عليه التجارب الوطنية والدولية بهذا الخصوص The management contract is a contract that stems from the business world and is of recent origin. It first appeared in America and then spread throughout the world because of its efficiency and impact in solving the problems of countries in terms of managing their institutions and refuting the obstacles and barriers that limit their growth. This is what is unique to it. Among the peculiarities that distinguish it from other contracts, including the transfer of power and raising the financial and economic profitability, in addition to the development of companies and dyeing them with modern technology with the transfer of technical and technical knowledge. This is what the Algerian legislator found in line with his requirements during the transitional phase that the country went through at the time, so he decided to attract the management contract and contain it in its legal system by allocating ten articles to it that specified the provisions of its application with the aim of framing the process of running the mixed economy companies and public economic institutions resulting from this contract, as it As soon as it is held, its effects will take effect in relation to each of its parties who, if they carry out their commitment to the fullest and in good faith, have contributed to improving the functioning of the mixed-economy companies in Algeria, which has been proven and confirmed by national and international experiences in this regard.
