الصفقات العمومية جرائم الفساد في مجال

Abstract

تعتبر الصفقات العمومية وسيلة أساسية لتجسيد البرامج التنموية وتحقيق التنمية الشاملة للدول حيث تكلف خزينة الدولة اعتمادات مالية ضخمة. لهذا أولاها المشرع الجزائري اهتماما كبيرا، لكن في نفس الوقت أصبحت في بعض الدول ومنها الجزائر أبرز مجال لتفشي ظاهرة الفساد بمختلف صوره. لهذا قرر المشرع الجزائري رقابة خاصة وحماية نوعية تختلف عن الرقابة الإدارية حيث تعد الأكثر فعالية وصرامة من غيرها وهي الحماية الجزائية لقواعد تنظيم الصفقات العمومية في إطار القانون المتعلق بالوقاية من الفساد ومكافحته الصادر بموجب القانون 06/01 المؤرخ في 20 فيفري 2006. وقد سلطنا الضوء في الفصل الثاني على آليات جرائم الفساد ومكافحته في مجال الصفقات العمومية المتمثل بالتجريم وعقوبات وأساليب التحري، على جرائم المتعلقة بالصفقات العمومية Résumé :فرنسية أو انجلزية Public deals are considered an essential means for embodying development programs and achieving comprehensive development for countries ,as they cost the state treasury huge financial credits .that is why the Algerian legislator gave it great attention but at the same time ,in some countries , including Algeria ,it has become the largest area for the spread of corruption in its various forms For this reason the Algerian legislator decided a special oversight and qualitative that differs from administrative oversight , as it is considered the most effective stricter than others ,which is considered the most effective and stricter than others ,which is the Algerian .
