شهر الدعاوى العقارية في التشريع الجزائري

Abstract

إن الهدف الأهم من شهر الدعوى العقارية هو إعلام المتعاملين في العقار محل النزاع و خاصة الغير بالوضعية القانونية للعقار أو الحق العيني المشهر، حيث سمح المشرع للمتضررين من الحقوق المشهرة بالطعن فيها وذلك من خلال ما اعتمده في المرسوم التنفيذي 76_63 المتضمن تأسيس السجل العقاري في المادتين 85 و72، وأكد على ذلك في القانون 08_09 المتضمن قانون الإجراءات المدنية والإدارية بعد صدوره في 2008 في المواد 17 و515 و519 منه. كما استحدث لاحقا المادة 16 مكرر من الأمر 75_74 المتضمن إعداد المسح العام للأراضي وتأسيس السجل العقاري وذلك بموجب قانون المالية لسنة 2019 والذي تناول مسألة إشهار الدعاوى القضائية وآثارها. حيث اشترط المشرع بموجب هذه النصوص إخضاع العريضة الإفتتاحية للدعوى العقارية إلى عملية الشهر لدى المحافظة العقارية المختصة إقليميا تحت طائلة عدم قبول الدعوى شكلا كجزاء لعدم الشهر.Résumé : فرنسية أو انجلزية The Important most goal of a real estate lawsuits registration is to inform prospective dealers in the property and all others , about the legal status of the property or the registered real right in dispute as the legislator allowed those affected by the registered rights to appeal against them according to the Executive Decree; 63-76 that includes the establishment of the real estate registry in articles 85 and 72 confirmed by the law 08-09 related to the Civil and Administrative after its issuance in 2008 in Articles 17 , 515 and 519 . The legislator later introduced Article 16 bis of Order n0 75-74 , related to the establishment of general survey of lands and the real estate registry, according to the Finance Law of 2019, which dealt with the issue of lawsuits registration and its effects. Whereas, according to these provisions, the legislator required that the initial petition of real estate lawsuit should be registered at the regionally competent, and registration administration to avoid the rejection of the lawsuit based on a procedural error.
