المرأة نصف المجتمع من المساواة النظرية إلى المساواة الجوهرية

Abstract

في ظل سكوت القانون تبقى العادات والتقاليد تضع المرأة في منزلة أدنى من الرجل سواء في الأسرة أو المجتمع، وهذا تطلب تدخل المشرع لإعطائها مكانتها التي تستحقها بدءا من الدستور. منذ سنة 2005 ولإعادة التوازن للعلاقة بين الزوجين سواء أثناء الحياة الزوجية أو في فترة إنهائها أصبح المشرع يقيم العلاقة بين الزوجين على أساس المساواة في الحقوق والواجبات، نتيجة له أصبح الزوجان يتحملان معا مسؤولية تسيير ورعاية شؤون الأسرة للنهوض بمستواها من الناحية المادية والمعنوية. إن الشراكة في تحمل المسؤولية تعني الشراكة في الأعباء والفوائد، وهذا يعطي الحق للمرأة أن تستفيد من مساهمتها في بناء ثروة الأسرة عندما تطلب ذلك خاصة عند انتهاء العلاقة الزوجية. Abstract: In the shadow of the silence of law, customs and traditions keep the women in a lower status than the men, whether in the family or in society. This requires the legislator's intervention to give her the status she deserves from the Constitution. Since 2005 and to restore the relationship equilibrium between the spouses either during the marital life or in the period of its break up, the legislator has established the relationship between the spouses on the basis of equal rights and duties. As a result, the couple has become jointly responsible for running and caring for family affairs to improve their material and moral level. The Partnership in responsibility bearing means partnership in burdens and benefits, and this gives the woman the right to benefit from their contribution to the construction of the family wealth when required, especially when the marital relationship ends.
