اختصاص المحكمة الجنائية الدولية بالنظر في جرائم الاحتلال الإسرائيلي على فلسطين

Abstract

إن موضوع اختصاص المحكمة الجنائية الدولية بالنظر في الجرائم التي يرتكبها الاحتلال الإسرائيلي على الشعب فلسطين، أخذت بعدا في القانون الجنائي الدولي ومن هذا المنطلق هدفت الدراسة إلى إلى تقديم المحكمة الجنائية الدولية، هيئة قضائية جنائية دولية، وتوضيح اختصاصها من أجل تقديم دراسة قانونية لجرائم الاحتلال الإسرائيلي على فلسطين، وفق ما تضمنه قانون روما الأساسي للمحكمة الجنائية الدولية. بالرغم من قبول دولة فلسطين لاختصاص المحكمة الجنائية الدولية و رغم أنه يعتبر نجاحا معتبرا، إلا أنه لا يحقق المسائلة القضائية لمجرمي الحرب الإسرائيليين، نظرا لموانع قانونية تتعارض مع هذا النتيجة. The subject of the jurisdiction of the International Criminal Court to consider the crimes committed by the Israeli occupation against the Palestinian people has taken on a dimension in international criminal law. From this standpoint, the study aimed to present the International Criminal Court, an international criminal judicial body, and to clarify its jurisdiction in order to provide a legal study of the crimes of the Israeli occupation against Palestine, in accordance with what is included in the Rome Statute of the International Criminal Court. Despite the State of Palestine's acceptance of the jurisdiction of the International Criminal Court, and although it is considered a significant success, it does not achieve judicial accountability for Israeli war criminals, due to legal obstacles that conflict with this result
