Abstract

إن من أسس قيام الانظمة الديمقراطية أن تضمن الدول مبدأ حريـة اختيـار الشـعب لممثليـه، وهذا المبدأ لا يتأتى إلا بموجب انتخابات نزيهة شفافة ودورية تجرى على أساس المساواة بين الجميع، وبموجب ذلك تقوم الدولة بوضع الآليات الكفيلة لتحقيقه، وعلى غرار تشريعات الدول الديمقراطية أوجد المشـرع الجزائـري عدة آليات، من أهمها تفعيل آلية الرقابة القضائية على العمليات الانتخابية كنوع أنواع الرقابة على نزاهة العملية الانتخابية يمارس من خلالها القاضي رقابته على القرارات الصادرة من الهيئات المشرفة على العملية انطلاقا من القيد في القوائم، أو الاعتراض على قوائم مكاتب التصويت، بالنسبة لجميع العمليات الانتخابية، إضافة إلى منازعات الترشيح فيما يخص انتخاب أعضاء المجالس المنتخبة المحلية أو الوطنية، والاعتراض على صحة عمليات التصويت وغيرها من الاجراءات لأول المراحل التي التي تمر بها العملية الانتخابية.One of the foundations for the establishment of democratic systems is that states guarantee the principle of the people’s freedom to choose their representatives, and this principle can only be achieved through fair, transparent and periodic elections conducted on the basis of equality for all.
