النظام التأديبي بين التشريع الوظيفي وقانون العمل في الجزائر – دراسة مقارنة

Abstract

الخطأ التأديبي هو كل إختلال بالقيام بالواجبات التي تقتضي سن سير انتظام واستمرار العمل داخل المؤسسة وكذلك الامتناع عن كل ما من شأنه إلحاق الضرر بالمشروع أو عرقلته لتحقيق الأهداف التي خصص من أجلها إذ يعد الأساس الذي تقوم عله العقوبة التأديبية، وهذه الأخيرة تخضع لضوابط فعالة نتيجة هيمنة مبدأ الشرعية عليها ولذلك تضطر السلطة الرئاسية إلى استعمال سلطة موازية لسلطة التأديب والتي لا تنتمي إلى التأديب لأنها تعرف بسلطة العقاب. كما أن الموظف والعامل يتمتعان بمجموعة من الضمانات وذلك في مواجهة السلطة الرئاسية عن طريق الإطلاع على الملف التأديبي، الإستعانة بمدافع أثناء مرحلة التحقيق كما يجب على الإدارة والمستخدم تسبيب القرار التأديبي وذلك قصد معرفة تناسب القرار المتخذ في حق الموظف أو العامل يتناسب والخطأ المقترف. In addition, the employee and the worker enjoy a set of guarantees in the face of the presidential authority by examining the disciplinary file, seeking the help of a defender during the investigation stage, and the administration and the employee must give reasons for the disciplinary decision, in order to know the proportionality of the decision taken against the employee or worker commensurate with the error committed.
