النظام الهيكلي للسلطة الوطنية المستقلة المشرفة على الإنتخابات

Abstract

"تهدف هذه الدراسة إلى إبراز وتحديد الأحكام القانونية المتعلقة بالجهاز الذي يتكفل بإدارة أو تسيير العملية الإنتخابية برمتها وذلك من خلال التنظيم الدقيق الذي يفضي إلى نزاهتها. وتعتبر السلطة الوطنية المستقلة للإنتخابات كنموذج فعال للإدارة الإنتخابية بعدما جربت الجزائر الأشكال الثلاثة ،المتمثلة في الإدارة الإنتخابية الحكومية، الإدارة الإنتخابية المستقلة والإدارة الإنتخابية المختلطة، و قد أنشأت السلطة الوطنية الإنتخابات بموجب القانون العضوي 19-07. لذا قمنا بتسليط الضوء على النظام القانوني للسلطة المستقلة من حيث مفهومها والتنظيم الإداري لها فصل ثان بينا فيه دور السلطة المستقلة في الإشراف على العملية الإنتخابية وإنتهت الدراسة بخاتمة كانت عبارة عن أهم النتائج التي توصلنا إليها والتي حثينا في مجملها على تثمين الدور الفعال الذي تقوم به السلطة المستقلة في تكريس النزاهة الشفافية للعملية الإنتخابية وكذلك في تجسيد مبادئ النظام الديمقراطي ""The present study aims to determine legal dispositions related to the body responsible for the good organization of elections. The national independent committee is considered as a model for the organization of elections after Algeria tried three other forms ie governemental electoral administration, the independent national electoral authority and mixed electoral administration. the independent national electoral authority for the organization of elections was created in accordance with the law 07-19. In this study, we tried to focus on the legal organization of the committee. In the introduction, we presented the research question in the study and the importance of the sudy. In the first chapter, we presented the legal organization of the committee, its definition and its administrative organization. In the second chapter, we presented the role of the committee in the supervision and organization of elections. The main results of the study are included in the conclusion in which focused mainly on the effecient and effective role played by this independent body. The study insisted on encouraging the work of this body as it represents a model of organizing the elections within a framework of integrity and transparency which are facets of a democratic system. "
