النظام القانوني للأمر الجزائي في التشريع الجزائري

Abstract

إن متطلبات بناء دولة الحق والقانون وصيانة حقوق الإنسان في إطار التزامات الجزائر الدولية بعد المصادقة على العديد من الاتفاقيات الدولية، إلى جانب الحاجة الملحة لإصلاح نظام العدالة الجزائية بسبب تصاعد ظاهرة الجريمة وتطور العلوم والتكنولوجيا، أدت إلى تضخم عدد القضايا الجزائية في ظل بطء الإجراءات وعدم فعاليتها. كل هذه العوامل دفعت المشرع الجزائري إلى تعديل قانون الإجراءات الجزائية بموجب الأمر (02/15)، حيث سعى من خلاله إلى إدخال تغييرات جوهرية على سير الإجراءات الجزائية مع احترام مبادئ المحاكمة العادلة. ومن بين هذه التعديلات، تم استحداث الأمر الجزائي كطريقة لإخطار المحكمة الجنحة بالدعوى. The requirements for building a state of law and justice, and safeguarding human rights in the context of Algeria's international commitments after ratifying numerous international agreements, along with the urgent need to reform the criminal justice system due to the rise in crime and the advancement of science and technology, have led to an increase in the number of criminal cases amid slow and ineffective procedures. All these factors prompted the Algerian legislator to amend the Code of Criminal Procedure through Ordinance (02/15), aiming to introduce fundamental changes in the conduct of criminal proceedings while respecting the principles of fair trial. Among these amendments, the penal order was introduced as a method for notifying the criminal court of the case.
