Abstract

"ملخـص تناول هذا البحث الطعن بالنقض أمام مجلس الدولة كأحد أهم طرق الطعن التي يكفلها المشرع للمتقاضي وذلك بغرض مراجعة الأحكام والقرارات الصادرة في صورتها النهائية أمام جهة أعلى. إن خصوصية النظام القانوني الجزائري في هذا الشأنيرتبط بتركيبة القضاء الإداري في الجزائر الذي يقوم على وجود محاكم إدارية ومجلس الدولة كجهة نقض وجهة موضوع في نفس الوقت مع غياب حلقة المحاكم الإدارية الاستئنافية التي أضحى وجودها ضروريا، وهو ما أثار العديد من الإشكاليات التي تطرق لها هذا البحث. ""Abstract This research dealt with the challenge of challenging the State Council as one of the most important methods of appeal provided by the legislator to the litigant in order to review the judgments and decisions issued in final form before a higher authority. The specificity of the Algerian legal system in this regard is linked to the structure of the administrative judiciary in Algeria, which is based on the existence of administrative courts and the Council of State as an object of objecting at the same time with the absence of the administrative courts of appeal, whose existence has become necessary, which raised many of the problems addressed by this research.
