دور الصناديق الوقفية في دعم البحث العلمي

Abstract

ملــــخص: قام الوقف بدور مهم في حياة المسلمين خاصة فيما يتعلق بالتّعليم والبحث العلمي، ومع تطور مجالات الحياة المدنية والذي أثر في قطاعات عديدة كان لزاماً على قطاع الأوقاف مواكبة هذه العصرنة، وإيجاد صيغ تمويلية حديثة أكثر تطوراً، فظهرت الصّناديق الوقفيّة، فكان موضوع دراستي " دور الصّناديق الوقفيّة في دعم البحث العلمي دراسة تحليلية في الفقه الإسلامي والقانون الوضعي "، والتي تمحورت حول الإشكالية التالية: كيف يمكن تفعيل الصناديق في دعم البحث العلمي في دولة الكويت وجامعة هارفارد ؟ وبناء على ذلك تم الاعتماد على المنهج الوصفي والاستقرائي والتحليلي والمقارن، ببيان الأحكام الشرعية والنّصوص القانونية التي عالجها الموضوع وذلك في خطة تضمنت مقدمة و ثلاثة فصول، تناولت في الفصل الأول ما يتعلق بمفاهيم حول الوقف والبحث العلمي، وفي الفصل الثاني دعم الصّناديق الوقفيّة في الكويت للبحث العلمي، وكان الفصل الثالث يوضح دعم الصّناديق الوقفيّة للبحث العلمي في جامعة هارفارد ثم خاتمة توصلنا فيها إلى نتائج أهمها: أنّ الصّناديق الوقفيّة من أحسن الصّيغ الحديثة للوقف النّقدي الجماعي، وقد أسهمت بشكل كبير في التّنميّة العلميّة ودعم البحث العلمي بفضل استثمارات أوقافها، أما التّوصيّة التي ركزت عليها فهي وجوب تطبيق الحوكمة في الصّناديق الوقفيّة، مع تعميم تجربتها في الدّول العربية لنتائجها الجيّدة في تطوير العملية التعليميّة عامة، والبحث العلمي خاصة. Summary: Waqf played an important role in the lives of Muslims, especially with regard to education and scientific research. With the development of areas of civil life, which affected many sectors, it was necessary for the Waqf sector to keep pace with this modernization and find more advanced, modern financing formulas. Waqf funds emerged, and the subject of my study was "The Role of Waqf Funds in Supporting Scientific Research: An Analytical Study in Islamic Jurisprudence and Positive Law." It revolved around the following problem: How can funds be activated to support scientific research in the State of Kuwait and Harvard University? Accordingly, we relied on the descriptive, inductive, analytical, and comparative approach, explaining the Sharia rulings and legal texts that the topic addressed, in a plan that included an introduction and three chapters. The first chapter dealt with concepts related to endowments and scientific research, and the second chapter dealt with the support of endowment funds in Kuwait for scientific research. The third chapter explained the support of endowment funds for scientific research at Harvard University, and then a conclusion in which we reached the most important results: that endowment funds are among the best modern funds for collective cash endowments, and they have contributed significantly to scientific development and support for scientific research thanks to the investments of their endowments. As for the recommendation that I focused on, it is the necessity of applying governance in endowment funds, with the generalization of their experience in Arab countries due to its good results in developing the educational process in general, and scientific research in particular.
