التنظيم الإداري لممارسة الشعائر الدينية لغير المسلمين في الجزائر

Abstract

" إن حرية ممارسة الشعائر الدينية هو مبدأ يدعم حرية الفرد أو الجماعة في الحياة الخاصة أو العامة في إظهار دينهم أو معتقداتهم أو شعائرهم الدينية وكذا حرية تغيير الدين، فالشعائر الدينية أشمل من غيرها من الحريات باعتبارها مجال فكري لا يسهل الاطلاع عليه إلا إذا عبر عنه الفرد بوسائل مختلفة كحرية الرأي والتعبير وغيرها من الحريات، حيث كفل المشرع الجزائري ضمانات ممارسة الشعائر الدينية لغير المسلمين، إلا أن هذه الضمانات منوطة باحترام القوانين وكذا خصوصية المجتمع الجزائري وأعرافه. وهذا ما دفع المشرع الجزائري إلى إصدار نصوص قانونية التي تنظم هذه الحرية من بينها الأمر 06/03 المتعلق بتنظيم ممارسة الشعائر الدينية لغير المسلمين. ولا يمكن أن تكون الحرية مطلقة لذا فإن المشرع الجزائري نظمها وضبطها وفقا لجملة من الضوابط والقيود حال ممارسة هذه الشعائر حفاظا على النظام العام والآداب العامة وكذا ح"Abstract Freedom of religion or religious liberty is a principle that supports the freedom of individuals and community both in private or public life to allow them practicing their religion, beliefs, or rites. It also includes the freedom to change one's religion or beliefs. The notion of religion or beliefs has a wide intellectual meanings that is not easy to access unless expressed in different means such as freedom of speech, Opinion and other freedoms. the Algerian legislator has gave guarantees for non-Muslims to practice their religious rites, but these guarantees are conditionally practiced on the respect of the laws, as well as the privacy and customs of Algerian society. For that reason, the Algerian legislator has issued legal texts to adjust this freedom, such as Order 06/03 related to regulating the practice of religious rites for non-Muslims. Freedom cannot be an absolute. Therefore, the Algerian legislator has regulated and adjusts it according to a set of conditions and restrictions to preserve public system and public morals in one hand, and to preserve the rights of others in the other hand.
