ممارسة حق الشفعة على الأراضي الفلاحية في ظل القانون 10- 03

Abstract

لقد ارتبط حق الامتياز الذي تستغل به الأراضي الفلاحية التابعة للأملاك الخاصة للدولة وكذا الأملاك السطحية المتصلة بها بعدة خصائص من أهمها إمكانية التنازل عنه بصفة مجانية أو بمقابل، ويتم في هذه الحالة الأخيرة تفعيل رخصة الشفعة تفاديا لأية أضرار يمكن أن تلحق بهذا الصنف من الأراضي، وبموجب هذه الرخصة يستطيع كل من الشركاء في الشيوع بالدرجة الأولى في المستثمرة الفلاحية الجماعية أو الديوان الوطني للأراضي الفلاحية بالدرجة الأولى في المستثمرة الفلاحية الفردية اقتناء حق الامتياز المتنازل عنه. ويستوجب في كلا الحالتين على المستثمر صاحب حق الامتياز اخطار الديوان الوطني للأراضي الفلاحية برغبته في التنازل عن هذا الحق حتى يتسنى لهذا الأخير مواصلة باقي الاجراءات التي تكتسي طابع الرسمية والتي يكون مآلها إما انتقال الحصة المتنازل عنها لمستثمر آخر في نفس المستثمرة الفلاحية أو للديوان الوطني ذاته والذي يمنحها من جديد إما ضمن سياسة تجميع المستثمرات الفلاحية أو عن طريق المزايدة كما قد يؤول حق الامتياز لطرف غيرهما بعد الحصول على رخصة من الوالي المختص.The concession with which the agricultural lands belonging to the private property of the state are used, as well as the surface properties connected to it, have been associated with several characteristics, the most important of which is the possibility of assigning it free or for a fee, and in this last case the pre-emption license is activated to avoid any damages that could be caused to this type of land, Under this license, each of the communal partners in the first place in the collective agricultural investment or the National Office of Agricultural Lands, in the first place in the individual agricultural investor, can acquire the concession granted.
