صلاحيات مجلس الأمة بين التوسع الفعلي و الظاهري على ضوء التعديل الدستوري 2016

Abstract

ملخص : تعد عملية سن التشريع الوظيفة الأساسية للسلطة التشريعية ، وبسبب تبني الجزائر نظام البيكاميرالية، فإن هذه الوظيفة يشترك فيها كلا غرفتي البرلمان وهما المجلس الشعبي الوطني ومجلس الأمة كقاعدة عامة . إلا أنّ مسألة ممارسة مجلس الأمّة لسلطته التشريعية حدّتها مجموعة من العراقيل وذلك من خلال السلطات المحدودة المخولة له . لكن نتيجة للتعديل الدستوري لسنة 2016 الذي حمل في طياته عدة تغيرات ، أهمها إعادة الاعتبار لمجلس الأمّة قصد تمكينه من ممارسة مهامه التشريعية بكل استقلالية، وذلك من خلال منحه سلطة المبادرة حتى وإن كانت في مجالات محدودة . وتعديل نسبة المصادقة على القوانين Abstract: The process of enacting legislation is the primary function of the legislative power, and because Algeria adopts the bicameralism system, this function is shared by both chambers of Parliament, the National People's Assembly and the Council of Nation as a general rule. However, the question of the National Council exercise of its legislative authority is limited by a set of obstacles through limited authorities conferred upon it. But, as a result of the constitutional amendment of 2016, which brought about several changes, the most important of which is the re-consideration of the Council of the Nation to enable it to exercise its legislative mandate in complete independence, by giving it the authority to initiate, even if in limited fields.
