دور المحكمة الدستورية في تفسير الدستور

Abstract

حظي تفسير نصوص الدستور بأهمية كبيرة في الأنظمة القضائية بسبب طبيعة النصوص الدستورية التي قد تكون غامضة في بعض الأحيان، مما يؤدي إلى وجود جهة مكلفة بهذا الدور. لهذا أنشأ المشرع الجزائري المجلس الدستوري كهيئة لتفسير الدستور, إلا إن هذا الأخير تعرض للعديد من المشاكل الإجرائية والسياسية حالت دون قيامه بدوره على الوجه المناسب. لذلك استحدث المؤسس الدستوري الجزائري في التعديل الدستوري لسنة 2020 محكمة دستورية كمؤسسة دستورية مستقلة تتولى تفسير الدستور. The interpretation of the texts of the constitution has gained great importance in judicial systems due to the nature of the constitutional texts, which may be ambiguous at times, which leads to the presence of a body entrusted with this role. This is why the Algerian legislator established the Constitutional Council as a body to interpret the constitution, but the latter was exposed to many procedural and political problems that prevented it from performing its role properly. Therefore, the Algerian constitutional founder, in the constitutional amendment of 2020, established the Constitutional Court as an independent constitutional institution that interprets the constitution.
