دور مؤسسات ضمان الاستثمار في توجيه الاستثمار الأجنبي

Abstract

ملخص: تسعى الدول النامية لجذب أكبر قدر من الاستثمارات الأجنبية لتمويل وإنجاز مشاريعها التنموية، ويصطدم هذا المسعى بعوائق أهمها المخاوف المرتبطة بالمخاطر غير التجارية. وبالرغم من الحماية القانونية التي توفرها قوانين تلك الدول كضمانات للاستثمار، إلا أن افتقاد هذه الأخيرة للقوة الملزمة جعلها عاجزة عن استعادة ثقة المستثمرين الأجانب. ولتجاوز هذا الوضع تم إنشاء مؤسسات تهتم بضمان الاستثمارات الأجنبية في الدول النامية، من خلال إبرامها لعقود الضمان التي تكفل تعويض المستثمر المؤمن له عن كل ما يصيبه جراء تحقق أيا من المخاطر غير التجارية المضمونة، إن سياسة التأمين هذه تعزز الثقة في الدول المضيفة للاستثمار التي توافق على إبرام عقد الضمان مما يعيد توجيه الاستثمارات الهاربة نحو هذه الدول لأغراض التنمية. Abstract: Developing countries seek to attract the largest amount of foreign investment to finance and implement their development projects. This effort is stymied by concerns related to non-commercial risks. Despite the legal protection provided by their laws as investment guarantees, their lack of binding power made them unable to restore the confidence of foreign investors. In order to overcome this situation, institutions have been established to ensure foreign investments in developing countries through the conclusion of insurance contracts to ensure that the insured investor is compensated for any damage caused by the confrontation of any non-commercial risks. This insurance policy reinforces confidence in the host countries that agree to the conclude security contracts, which redirects the fugitive investments towards these countries for development purposes.
