Abstract

أخذت الطرق البديلة في تسوية منازعات الاستثمار الاجنبي مكانة مرموقة في تحقيق ما أخفقت فيه الجهات القضائية لمختلف الدول فتمكنت هذه الوسائل البديلة من المساهمــة في حل العديد من المنازعات الناشئة بين المستثمر و الدولة المضيفة من خلال توفيــر العديد من المزايا والضمانات التي لم يحض بها المستثمر في لجوئه لقضاء الدولة المضيفـة للاستثمـار فأصبحت هذه الوسائــل البديلـة حلولا مقبولـة مـن أطـــراف النـزاع لمــا تعكســه مـن طمأنينــة وسريــــة و سرعـــة الفصـل و فــــي المحافظـــة أيضا على العلاقـــــــة العقديــــة القائمـة بينهـــا، و هو ما عملت عليه الدولة الجزائرية في هذا الاتجاه من خلال تحيين وتعديل قوانينها المرتبطة بالعلاقة الاستثمارية وتعزيز فعالية كل من الصلح و الوساطة والتحكيم كوسائل تسوية بديلة للنزاعات عن القضاء .Alternative means of settling foreign investment disputes took a prominent position in achieving what the judicial authorities of various countries failed to do. These alternative means were able to contribute to resolving many disputes arising between the investor and the host country by providing many advantages and guarantees that the investor did not have in resorting to the court. The host country for the investmentThese alternative means have become acceptable solutions by the parties to the conflict because of their reassurance, confidentiality, speed of separation and the preservation of the existing contractual relationship between them, which is what the Algerian state has worked on in this direction by revising and amending its laws related to the investment relationship and offering both reconciliation And mediation and arbitration as alternative means to the judiciary to settle foreign investment disputes.
