الأمن الأسري وآليات تحقيقه في الفقه الإسلامي والتشريع الجزائري

Abstract

تتناول هذه الدراسة موضوعا هامّاً، على مستوى التشريعَين؛ الفقهي الإسلامي والوضعي الجزائري، يتعلّق ببقاء الأسر ودوام استقرارها وترابطها؛ فهي تسعى بشكل حثيث لكشف ما يحقق أمنها، ومعرفة ما يهدده، لذا جاءت إشكالية هذا الموضوع: "إلى أي مدى وُفق الفقه الإسلامي والمشرع الجزائري في معالجتهما لأمن الأسر وتحقيق دعائمه؟". وحتى تتم الإجابة عن هذا؛ فقد قُسّمت الدراسة إلى أربع فصول، تناول الأول منها، مفهوم الأمن الأسري وبيان تأصيله في التشريعَين الإسلامي والوضعي الجزائري، أما الثاني فقد سلّط الضّوء على أبرز المهددا ت التي يواجهها، ا ولفصل الثالث والرابع، بحثا وعالجا الآليات المحققة له في الوسط الأسري. لتصل الدراسة إلى طائفة من النتائج، كان أبرزها؛ أن للأمن الأسري مهددات كثيرة وخطيرة؛ وهذا بدوره أدى إلى ضرورة إيجاد آليات تشريعية متنوعة ومتعددة محققة لهذا الأمن، وشاملة لجميع نواحي الأسرة وأفرادها، أ ووصت في الأخير بضرورة سنّ وتشريع المزيد من الآليات التي تحقق وتحفظ أمن الأسرة من باب المصلحة؛ كتشريع الخضوع إلى دورات تكوينية وتعريفية لفائدة المقبلين على الزواج. This study deals with an important subject at both level of legislation: The Islamic jurisprudence and the Algerian statutory law, concerning with the family’s survival and ensure its stability and cohesion; it aims to reveal the security and knowing the threats. So, the problem posed in this study is “to what extant does the Islamic jurisprudence and the Algerian statutory law were granted success to solve security and family stability with achieving its supports?”. To get answer about that; the study was classified to four chapter; the first is about the family security with clarifying its rooting in the two legislations, the second is focused on the main threats that faces them; the third and fourth chapters are searched the mechanisms that realize the family security and solved it. The research concluded to many results; most notably one is: there are many threats surround the family security that led to find a various legislative mechanism to achieve the security to the family and its members overall. In the end it must to legislate more of mechanism that realize and save family security like making a formulative courses to those who going to get married.
