دور التحقيق العقاري في تسوية وضعية العقارات غير الممسوحة

Abstract

إن التحقيق العقاري إجراء حديث وضعه المشرع الجزائري بموجب قانون 07/02 والمرسوم التنفيذي 08/147 لسد الفراغ الذي أحدثه تخلف العمل بعقود الشهرة وشهادات الحيازة لما فيها من سلبيات، فالتحقيق العقاري له دور كبير في تطهير الملكية الخاصة عن طريق إعداد سندات الملكية، وهذا لمسايرة التطلعات الاقتصادية والاجتماعية للبلاد، لكنه عرف هذا التحقيق مشاكل ميدانية واجهت المحقق العقاري أثناء عمله، يتحتم على المشرع الجزائري تداركها بإحداث نصوص قانونية معدلة ومذكرات لاحقة.
