Abstract

تتمتع الإدارة المتعاقدة بسلطة تعديل الصفقة العمومية بإ ا ردتها المنفردة باللجوء إلى آلية الملحق، الذي يشكل وثيقة تعاقدية تابعة للصفقة ويكون الهدف منه الزيادة في الخدمات أو تقليلها أو تعديل بند أو عدة بنود تعاقدية في الصفقة، ويكون ذلك بم ا رعاة مجموعة من الضوابط والقيود التي تحكم مشروعية إب ا رمه. يخضع الملحق للفحص من طرف هيئات الرقابة الخارجية القبلية، وذلك للتحقيق من مدى مطابقته للأحكام المنصوص عليها في تنظيم الصفقات العمومية وتفويضات المرفق العام. نظ ا ر لتغليب فكرة المصلحة العامة عن المصلحة الخاصة أثناء تعديل الصفقة العمومية فإنه يمكن أن يثير ذلك ن ا زعات بين الأط ا رف المتعاقدة ويتم حلها وديا قبل اللجوء إلى القضاء..The contracting administration has the authority to amend the general deal by its sole will by resorting to the attachment mechanism, which constitutes a contractual document belonging to the deal and the aim of which is to increase or reduce services or amend an item or several contractual clauses in the deal, and that is by observing a set of regulations and restrictions that govern its legitimacy . The appendix is a subject to examination by tribal external oversight bodies in order to verify its compliance with the provisions stipulated in the organization of public deals and the mandates of the public facility. In view of the prevalence of the idea of the public interest over the private interest during the amendment of the public deal, this con provokes disputes between contracting parties which can be resolved amicably before resorting to justice.
