الضمانات القانونية لمتابعة مرتكبي الانتهاكات الجسيمة ضد المرأة

Abstract

جراء الانتهاكات الجسيمة التي أصبحت تتعرض لها المرأة زمن النزاعات المسلحة والحروب الأهلية خاصة جرائم العنف الجنسي بطرق وحشية تقشعر لها الأبدان، سارع المجتمع الدولي إلى تفعيل حمايتها بإنشاء آلية قضائية دولية دائمة لتثبيت المسؤولية الجنائية وفرض العقوبة على مقترفي تلك الانتهاكات تحقيقا للعدالة الجنائية من خلال تقنين تلك الجرائم أولا في نظامها الأساسي والذي يعد من أهم ضمانات عدم الإفلات من الملاحقة والمتابعة القضائية ومن ثم وضع ضمانات قانونية تسمح بإقامة تلك المسؤولية والمتمثلة أساسا في الإقرار بعدم تقادم الجرائم الدولية ضد المرأة من جهة وعدم العفو عنها من جهة أخرى. Abstract: As a result of the grave violations that women are suffered from, in times of armed conflict and civil wars, especially sexual violence, which is exercised in brutal and chilling ways, the international community has accelerated its protection by the institution of permanent international judicial organization to establish criminal responsibility and punish the responsible to realize the criminal justice The first of its crimes in the principle organization, which is considered as one of the most important guarantees of non-avoidance from judicial prosecution follow-up, and thus constitution of legal guarantees wich result the creation of that responsibility, namely, the recognition of the non-applicability of international crimes against women from one part and non amnesty from the other part.
