الإدارة الالكترونية وأثرها على النظام القانوني للمرفق العام

Abstract

إن تسارع وتيرة التغي ا رت والتطو ا رت التي يشهدها العالم اليوم، خاصة في ظل ما يعرف بنظام الإدارة الالكترونية، وما لذلك من ارتباط وثيق بتطبيق تكنولوجيا المعلومات والاتصال في الم ا رفق العامة الإدارية، بهدف أداء الخدمات الحكومية بسرعة وفاعلية مما يؤدي إلى تحقيق الشفافية، ويساهم ولو جزئياً في القضاء على البيروق ا رطية، وبذلك تساهم الخدمات التكنولوجية بشكل كبير في تحسين علاقة الإدارة بالمواطن. وتخضع الم ا رفق العامة على اختلاف أنواعها وتصنيفاتها لمجموعة من المبادئ العامة الموحدة اللازمة لإنجاز مهامها في تحقيق الصالح العام على أفضل وجه، وعليه فإدارة الم ا رفق العامة بنظام الإدارة الالكترونية بدلا من إدارتها بالطريقة التقليدية، ينبغي أن يت ا زمن مع تطوير وتفسير المبادئ العامة التي تحكم المرفق العام للتوافق مع النظام الالكتروني. ولمعرفة تأثير نظام الإدارة الالكترونية على المبادئ المرفقية، اقتضى منا الأمر التعرض لموضوع الإدارة الالكترونية، ثم توضيح تأثيرها على كل مبدأ من المبادئ التي تحكم سير الم ا رفق العامة، وهذا ماحاولنا د ا رسته في موضوع بحثنا من خلال هذه المذكرة.Our world is witnessing today changes and developments so rapidly, especially in terms of electronic management system, in addition to the application of information and communication technologies in the administrative public services in order to perform government services quickly and effectively that what lead to realise transparency and fighting bureaucracy. Thus, technological services contribute significantly in improving citizen-andministration relationship. All types of public utilities are subject to a set of common general principles which are necessary for accomplishing tasks in the best interests of public. Therefore, administering public utilities by the use of the electronic management system instead of traditional one should be associated with a development and interpretation of general principles governing the public utility. In order to understand the impact of the electronic management system on the attachment principles, we have had to deal with it and to explain its impact on each of the principles governing the conduct of public utilities
